Harvey Elder v. Judith Barzilay

Harvey Elder alias Mole Man v. Judith Barzilay (2nd Cir. 2005) is a U.S. Second Circuit Court of Appeals defamation case brought by Harvey Elder (A.K.A. "Mole Man") for a comment in the ruling of Judith Barzilay in Toy Biz, Inc. v. United States, namely that Elder was not a human being.[1]
Central to Elder's suit was Barzilay's description of Elder as having "exaggerated troll-like features [and] unusually pale skin" and being "a caricature of a human being."
President George W. Bush described the outcome as "a victory for democracy."[#]
